Terms of Service

Welcome to EVEMPIRES. By downloading, installing, or using the EVEMPIRES mobile application ("App") or accessing our website (evempires.net), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

1. ACCEPTANCE OF TERMS

By using the EVEMPIRES App or website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Official Sweepstakes Rules. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. ELIGIBILITY

You must meet the following requirements to use our services:

Be at least eighteen (18) years of age
Be a legal resident of the United States
Have the legal capacity to enter into a binding agreement
Possess a valid U.S. driver's license (required to claim sweepstakes prize)

By using our services, you represent and warrant that you meet these eligibility requirements. If you do not meet these requirements, you must immediately stop using our services.

3. ACCOUNT AND DEVICE REGISTRATION

When you use our App, a unique device identifier is automatically generated to track your gameplay progress, tokens, and sweepstakes entries. You are responsible for:

Maintaining the security of your device
All activities that occur under your device/account
Providing accurate information when entering the sweepstakes

4. PURCHASES AND PAYMENTS

App Purchase and In-App Purchases

The EVEMPIRES App is available for purchase through the Apple App Store. Additional tokens may be purchased within the App. All purchases are:

Processed through Apple's payment system
Subject to Apple's terms and conditions
Verified through Apple's receipt verification system
Final and non-refundable except as required by law

Token System

Tokens are digital items that can be redeemed for sweepstakes entries. Tokens:

Have no cash value and cannot be exchanged for money
Are non-transferable between accounts or devices
May only be used within the EVEMPIRES App
Are subject to verification before entry redemption

CHARGEBACKS AND REFUNDS

If you initiate a chargeback, dispute, or refund request through Apple or your financial institution for any EVEMPIRES purchase:

ALL tokens associated with your account will be immediately revoked
ALL sweepstakes entries associated with your account will be invalidated and removed from the drawing
Your account may be permanently suspended
You may be disqualified from all current and future EVEMPIRES sweepstakes
EVEMPIRES reserves the right to pursue legal action to recover any prizes wrongfully claimed

This policy applies regardless of which specific purchase was refunded or charged back.

5. SWEEPSTAKES PARTICIPATION

Participation in the EVEMPIRES sweepstakes is governed by our Official Sweepstakes Rules. By entering the sweepstakes, you agree to:

Comply with all Official Rules
Provide accurate and truthful information
Accept the decisions of EVEMPIRES as final
Cooperate with prize verification and delivery

6. PROHIBITED CONDUCT

You agree NOT to:

Use any unauthorized third-party software, hacks, mods, or cheats
Attempt to manipulate, exploit, or circumvent the App's systems
Create multiple accounts or use multiple devices to gain unfair advantage
Use pirated, cracked, or unauthorized versions of the App
Attempt to bypass purchase verification systems
Submit false or fraudulent sweepstakes entries
Harass, threaten, or harm other users or EVEMPIRES staff
Use the App for any illegal purpose
Reverse engineer, decompile, or disassemble the App
Initiate chargebacks or fraudulent refund requests

Violation of these prohibitions may result in immediate termination of your account, forfeiture of tokens and entries, and potential legal action.

7. INTELLECTUAL PROPERTY

All content, features, and functionality of the EVEMPIRES App and website, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of EVEMPIRES and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or included software without our express written permission.

8. DISCLAIMER OF WARRANTIES

THE EVEMPIRES APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, secure, or error-free
Any defects will be corrected
The App is free of viruses or harmful components
The results of using the App will meet your expectations

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEMPIRES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR WEBSITE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO EVEMPIRES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless EVEMPIRES, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

Your use of the App or website
Your violation of these Terms
Your violation of any third-party rights
Any content you submit or transmit through our services

11. TERMINATION

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

Your right to use the App immediately ceases
Any tokens in your account will be forfeited
Any pending sweepstakes entries may be invalidated

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of such courts.

Waiver of Class Action

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. APPLE-SPECIFIC TERMS

If you download or use the EVEMPIRES App from the Apple App Store:

These Terms are between you and EVEMPIRES, not Apple
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for any claims related to the App
Apple is a third-party beneficiary of these Terms

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Official Sweepstakes Rules, constitute the entire agreement between you and EVEMPIRES regarding your use of our services and supersede all prior agreements and understandings.
